Constitution

    Name:
  • The Association shall be known as Uttarakhand DAO/DA Association, herein after called as Association. The office of the Association will be located at the capital of the state.
  • The state Association will be an affiliate unit of All India federation of Divisional Accountants’ Association as per existing rules.

  • Objects:-
  • To improve the official efficiency and promote the material, moral, mental and social welfare of its members and to establish close and better relationship between employers and employees.
  • To represent on constitutional lines the grievances of the members in regard to their pay and allowances, prospects, leave, pension etc and seek for their redress by all legitimate means.
  • To cultivate a feeling of brotherhood and cooperative spirit among its members.
  • To offer and obtain the sympathy and support of the sister Associations of Divisional Accountants in India in the attainment of the common objects.

  • Note:-
  • The association will not indulge in politics and will have no affiliation with any political bodies or parties.
  • The association will not represent the interest based on any caste, tribe or religious denomination.
  • All members should inculcate the principles of unity, self-help and responsibility, independence and honesty of purpose cooperation in all departmental reforms, and a striving after efficiency and maintenance of discipline should be kept prominently before them. They should urge themselves to individual activity and realize that they are labouring for cause, which is to stand the test of time.

  • Membership:-
  • Persons of the following classes of Divisional Accountants’ cadre of Uttarakhand will be the members of the Association:-
    • Divisional Accountants whether permanent or temporary.
    • Divisional Accountants promoted to the post of Divisional Accounts officers Grade I,II and Sr DAOs.
    • Divisional Accountants on probation.
  • No one may enlist or continue to be a member of the association who does not desire, or in any way objects, to be openly connected with the Association.
  • The association reserves to itself the right to cancel the membership of any member on reasons, which may tend to affect the general interest of the Association adversely.
  • A member’s connection with the association will terminate in any of the following ways:-
    • By voluntary resignation.
    • By his death, dismissal or resignation or his appointment or by his permanent transfer to any other state or cadre or retirement.
  • A member connected with the Association may be declared terminated in the following cases:-
    • By failure to pay his subscription, and
    • By not conforming to the rules of the association.
  • Until otherwise decided by the Executive Committee the monthly subscription @ 50 Rs. (Fifty Rupees)/month will be deducted from the pay of member employee.
  • The funds of the association will consist exclusively of subscription from members and grants if any made by the government and will be applied for the furtherance of the objects of association.
  • The financial year will be reckoned from April 1 to March 31st.
  • No member shall have any claim to a refund of any money paid by him during the period of membership, nor shall have any right over any assets movable or immovable, of the association.

  • Constitution:-
  • The business of the association shall be conducted by a executive committee of 10 elected members composed of one President, one vice President, one General Secretary, one Joint Secretary, one Finance Secretary, one Audit Officer and four Executive Members.
    • Any member of the executive committee who without adequate reasons absents himself for three consecutive meetings shall be considered to have vacated his seat but shall be eligible for reinstatement by the Executive committee.
    • Vacancies occurring within the same session shall be filled up at the discretion of the Executive Committee by co-option.
  • The Executive Committee shall continue to hold office till the next session, which will be held in the general conference of the Association.
  • Fresh election of office bearers should be held once in two years, in exceptional cases and for bonafide reasons, the executive can extend this term by three months. After expiry of the extended period, in case no meeting of the general body is called either by the General Secretary or the President, then on the written request of the majority of Executive Members, Joint Secretary shall call the meeting for election of new office bearers. The retiring person shall be eligible for re-election.

  • Duties:-
  • The President of the Association will preside at all meetings of the association. In his absence, Vice President will preside; In absence of all the two, President will be elected from amongst the members present. In case of tie of votes, the President of the meeting will be entitled to cast vote. He and General Secretary are authorized to correspond with the authorities and other sister associations etc. for the furtherance of the objects of the Association on behalf of the Association. Any member of the Executive Committee who happens to be stationed at Dehradun shall be responsible for keeping an effective liaisonbetween the association and the Accountant General, Uttarakhand. He should keep the President and the General Secretary fully informed of all developments. In case no member of the Executive committee is posted at any time at Dehradun, President shall nominate any of the members of the Association stationed at Dehradun to do this job.
  • The General Secretary shall be in executive charge of the association and shall manage and control its affairs, under the direction of the Executive committee. He shall also perform all other work in conformity with the resolutions passed in keeping with the rules of the Association.
  • The General Secretary shall pass all bills of payments.
  • The Joint Secretary will act under the instructions of the General Secretary and help him in carrying out the general business of the association. In the absence of the General Secretary, Joint Secretary shall be responsible for the collection of subscription from the drawing and disbursing officer under the check off system and not in case of any individual employee and safe custody of all money due to the association and grant receipts for them in such accounts book as may be prescribed for the purpose by the Executive committee. He shall also pay all local bills, obtain vouchers for all payments as for as possible. The surplus funds should be remitted to the Finance Secretary.
  • The account of the association shall be kept in any nationalized bank at the place of posting of the General Secretary and shall be operated by the General Secretary, Finance Secretary or President of the Association, jointly.
  • The Executive Committee shall meet occasionally to transact the general business of the Association such as :-
    • to read and confirm the minutes of the previous meeting.
    • to dispose off applications for with drawl of membership.
    • to consider proposals from any member, etc
  • Power for incurring expenditure out of the funds of the Association in furtherance the interest of the Association is vested to the following:-
    • The Secretary shall pass for payments of all bills for contingent charges and ordinarily have authority to spend sums up to Rs.500/- every month without the sanction of the Executive Committee. He can also pay printing charges etc. for quarterly bulletin and other matters related to Association.
    • After closing of the financial year the audited annual account of the Association must be tabled before Executive Committee in its meeting held within three months of closing.
  • The Executive Committee shall utilize the funds of the Association only to the extent of the assets of the Association.

  • POWERS:-
  • The Executive Committee shall be competent to appoint sub-committees either from out of its own members or from among the other members of the association in order to perform some special work for the time being. The General Secretary or the Joint Secretary will be an Ex.Officio member of these sub-committees.
  • The Executive Committee may suspend a member or cancel his membership, if in its opinion, the conduct of such a member appears objectionable or is detrimental to the interests of the Association. Such a member shall, however, have the right of appeal to the General Body of member whose decision in this connection shall be final.
  • The Executive Committee will have power to make by-laws for carrying out any particular branch of work conducive to the welfare of Association.
  • The Executive Committee shall be the sole authority for the addition, alteration or interpretation of rules now made or hereafter to be made and its decision upon all questions or upon any matter affecting the Association shall be final and binding upon the members. However, it has to be got approved in the next general body meeting.
  • Any amendment in the constitution will be done with the prior approval of C& AG of India, likewise C& AG of India can ask the Association at any time to carry out amendments in the constitution.
  • Audit Officer will audit the account of the year and the annual balance sheet shall be published by the Executive Committee along with the annual report.
  • The meetings of Executive Committee and the general body of the members shall be convened by the Secretary and they shall be presided over by the President, who shall have a casting vote in case of tie. On a show of hands or on a poll each member present in person shall have one vote.
  • The business of the Association shall also be carried on through circulation of the agenda; the members recording their view against each point of the agenda and majority of opinion expressed in writing would be considered the view of the members.
  • Ordinarily fifteen days prior notice shall be given to the members together with an agenda of business proposed to be considered in the meeting, but in emergent or special cases a shorter notice will serve the purpose. Non-receipt of the notice by any member will not invalidate the proceedings of such a meeting.

  • MEETINGS:-
  • Quorum:- The quorum for annual General Body Meetings, General Body meetings or special meetings shall be 1/3rd of total strength of the primary members, similarly for Executive Meetings the quorum shall be 1/3rd of the Executive Body. In the absence of quorum such meetings will be adjourned.
  • At the meeting a resolution put to vote of the meeting shall be decided upon by the majority of votes but no resolution affecting the constitution or object of the association shall be carried unless it is voted by not less than 2/3 of the members present.
  • An extraordinary meeting of the Executive Committee may be convened by the Secretary on a written requisition signed by six members of the Executive Committee. In case of failure, Joint Secretary may call the meeting of the Executive Committee.

  • Dissolution:-
  • In the case of the dissolution of the association the net assets will be disposed off in such a manner as may be decided upon by 3/5 of members of the association and in the case of liquidation if the assets are not sufficient to meet liabilities, the liability of each member of the association shall be limited to his half yearly subscription at the time of such liquidation.
